Although their results are essentially the same, expunction and non-disclosure are actually different procedures. Expunction is an order from a district court judge to physically and electronically destroy records related to your arrest and the disposition of your case if you were acquitted; the case was dismissed because of police errors or lack of probable cause; pardon by the governor; or after completion of non-supervised deferred adjudication for a class C misdemeanor.

An order not to disclose (OND) comes from the supervising court if you received deferred adjudication and completed it successfully. Unlike expunction, in which your records are physically destroyed, an OND is less broad and is only an order to the Department of Public Safety to not disclose your record during a routine background check. Some crimes are ineligible for an OND, including assault, family violence and some DWI charges.
