If you are convicted of certain criminal offenses, you may be able to have them removed from your record. The great advantage of this is that you will be able to respond honestly when asked if you were arrested for a crime. In addition, your arrest will not appear during private background checks.
Our Bexar County lawyer, Kyle C. Simpson will file the application for expunction or an order not to disclose (OND) and get the record cleaned. This can help with obtaining employment, housing, loans and financial aid, security clearances. Your record will not show an arrest, conviction or adjudication

Although their results are essentially the same, expunction and non-disclosure are actually different procedures. Expunction is an order from a district court judge to physically and electronically destroy records related to your arrest and the disposition of your case if you were acquitted; the case was dismissed because of police errors or lack of probable cause; pardon by the governor; or after completion of non-supervised deferred adjudication for a class C misdemeanor.
An order not to disclose (OND) comes from the supervising court if you received deferred adjudication and completed it successfully. Unlike expunction, in which your records are physically destroyed, an OND is less broad and is only an order to the Department of Public Safety to not disclose your record during a routine background check. Some crimes are ineligible for an OND, including assault, family violence and some DWI charges.
